These are the Terms & Conditions as defined for “Smart Airport Parking Ltd” related to all its operations and processes including but not limited to making a booking for your vehicle’s parking. Kindly read and understand the following terms and conditions carefully before placing your order. Any queries or complaints should be submitted in accordance with these Terms & Conditions.

TERMS AND CONDITIONS FOR Smart AIRPORT PARKING LTD.

The Contract between Us:

  • The whole amount for the parking fee that the customer has booked our services for must be paid to us in full before the confirmation of booking. Once the payment has been received to us we will send you online confirmation of the booking via an automated email at the address that was provided to us in the online booking form. Accepting the order creates a legally binding contract between the customer and us.
  • Price Disclaimer:

  • The price payable for parking that you book is set out in our website and confirmed during the online booking process.
  • You will need to pay extra charges if your vehicle is parked for an extended period than that mentioned on your booking form or you fail to collect your vehicle within the stipulated period.
  • Customer's Right to make Changes or cancel the contract:

  • It is possible to make changes to your booking but to confirm your changes it is necessary to contact us at least 48 hours before the date and time of your arrival. Any additional charges for the extended parking period are charged at £15 per day.
  • You can cancel your parking contract that you have made at this website at any time up to 48 hours prior to the date and time of arrival mentioned on your booking confirmation. Under this condition, the whole amount charged for parking will be refundable.
  • To cancel your contract you must notify us in writing by sending an email at info@smartairportparkingltd.co.uk or calling us at telephone 03333 216 212.
  • Once you notify us that you are canceling your contract, any amount debited to us from your credit card will be credited to your account as soon as possible and in any case, will be reversed within 30 days of the date of your booking confirmation.
  • If you have booked a special non-refundable marked package, then such an offer will not be possible to amend or cancel. With non-refundable packages, you will be entitled to no refund.
  • Company's Right of Cancellation:

    The company reserves the right to cancel any contract if:

  • Any of our parking services was listed at the wrong price due to a typographical error or an error in the pricing information on our website.
  • If we cancel your contract we will notify you by email and will credit to your account any sum deducted by us from your credit card as soon as possible but in any case within 30 days of your booking confirmation. We will not be obliged to offer any other compensation for the inconvenience suffered.
  • Liability:

  • Your vehicle and any personal possessions including movable items left behind in your vehicle are at your risk while the vehicle is in our possession.
  • When you leave your vehicle to park with us, you will be required to confirm whether the vehicle has any previous damages or not. We are not responsible for minor/invisible damages such as scratches and dents. However, we do not accept any liability for any mechanical, structural, or electrical failure of your vehicle, including windscreens, mirrors, tires, or alloy wheels damages, however incurred. Please report any claims to our staff upon your return car transfer. We do not accept any liability for any claims you make afterwards.
  • Your vehicle must be properly taxed and should comply with the Road Traffic Act 1988.
  • We will not be held responsible for any punctures or flat batteries in your vehicle or if your vehicle breaks down while in our possession.
  • In any case, the losses caused to you as a result of the negligence of our employees, shall be limited to the amount of £20,000 for one incident or the series of incidents. In the event that your vehicle needs to be repaired, as a result of our negligence, it must be carried out by our own approved organization and we will pay for it upto the specified limit.
  • Save as precluded by law, we will not be held responsible for:

  • Any indirect or consequential loss, damage or expenses (including loss of profits business or goodwill, costs due to delayed or missed flights) howsoever caused by any breach of contract or negligence on our part;
  • Any loss or damages covered by your own car insurance.
  • Any damage incurred to your vehicle due to a force majeure event(as set out below)
  • Your failure in following any reasonable instructions provided to you by our representative at the time of arrival and departure.
  • Notwithstanding the foregoing, these Terms and Conditions are not intended to limit any consumer rights you as a user may have under applicable local law or other legal rights which cannot be excluded nor we may in any way exclude or limit your liability for any death or personal injury as a result of our negligence.
  • Incidents beyond our control, as we will not be liable to you for any failure to provide our services in the event of any incident or circumstance beyond our reasonable control, or delays in doing so, without limitation, strikes, lockdowns and other industrial measures / conflicts, weather, airport closure or network access issues due to weather forecasts, floods, fires, explosions, accidents or terrorist incident ("Force Major Event"). For Meet and Greet Parking - Sometimes due to unforeseen circumstances such as delays in flights etc, it is not always possible for us to meet flights on renewed scheduled times; however, you can be certain that we will do our utmost to meet you ASAP.
  • Invalidity

  • If any a part of these terms and conditions is deemed unenforceable (including any provision within which we tend to exclude our liability to you) the enforceability of the other part of these conditions will not be altered and considered in-affect.
  • Privacy:

  • You acknowledge and conform to the terms of our privacy policy and are in agreement with them.

    Third-Party Rights

  • With the exception of our affiliates, directors, representatives or employees, any individual that is not party to this agreement has no right whatsoever beneath the United Kingdom Contracts (Rights of Third Parties) Act 1999 to enforce any terms or conditions of this agreement however this doesn't have an effect on any rights or remedy of a third party that exists or is out there apart from that Act.
  • Governing law

  • The parking contract in place between us shall be ruled by and interpreted in accordance with English law and English courts shall have the jurisdiction to resolve any disputes that may arise between us.
  • Entire agreement

  • These terms and conditions, along with our current web site pricing, contact details, and privacy policy, outlines the total of our agreement regarding the provision of parking services to you by us. Nothing
  • said otherwise by any employee or an individual on our behalf ought to be understood as a variation of these terms and conditions or as a certified illustration regarding the character or quality of any services provided by us. Save fraudulent conduct or dishonest interpretation, we are not held liable for any such misrepresentation being untrue or misleading in its meaning.
  • Missing your drop off time

  • Missing out on your drop off time or in case of a no show; our customers are advised to allow ample journey time to get to Luton airport or our compound for the collection or delivery of the vehicle at the meeting time that has been appointed by the customer. If the customer is delayed for any reason and as a result misses their booking time, they may be charged with extra prices. The customers must ensure that they contact Smart Airport Parking Ltd through appropriate channels and duly inform about any changes that they want as soon as possible. The responsibility to arrive at the agreed time lies with the customer and we would not be held responsible for any delays and resulting inconveniences. Smart Airport Parking Ltd cannot be held answerable for any extra charges or inconvenience incurred when the instructions provided by the corporate are followed by the customers. We tend to reserve the right to vary late meet and greet customers to park and ride service type. Late customers are taken to the airport within the next available minibus that has space available to transfer them.
  • Disclaimer

  • If there are adverse atmospheric conditions causing low visibility or your automobile is dirty at the time it is inspected for damages, Smart Airport Parking Ltd will not take any liability for any damage that can't be seen or pointed out at the time of the signature. The cases in which we will be liable have already been mentioned up there.
